The law's retroactive bifurcation provision applies immediately to all pending and future cases regardless of when the injury occurred, fundamentally altering how these cases proceed to trial.
Under the bifurcation provision, juries in slip and fall or premises liability cases now decide fault before hearing any evidence about the victim's injuries, medical bills, or suffering. For Atlanta slip and fall and premises liability victims whose cases involve more than $150,000 in damages, defendants can request bifurcation before trial, requiring plaintiffs to build liability cases strong enough to win without the emotional weight of injury evidence.
"The retroactive nature of Senate Bill 68's bifurcation rule means Atlanta residents injured in slip and fall incidents before April 21, 2025, now face a trial structure that didn't exist when their injuries occurred," said Maha Amircani, Founder of Amircani Law. The legislation also replaced Georgia's prior negligent security standard entirely. The previous "totality of circumstances" test from Georgia CVS Pharmacy v. Carmichael was eliminated. Property owners can now only be held liable for third-party criminal acts if they had specific knowledge of an imminent threat or prior substantially similar crimes on the property.
Additionally, Senate Bill 68 shortened the voluntary dismissal window for Georgia personal injury cases from "before the first witness is sworn" to 60 days after the defendant files an answer, compressing the timeline for Atlanta personal injury victims to evaluate their legal position before becoming locked into litigation.
